Costly Decisions in Long Term Disability Cases

You may still be working but have functional limitations which may be severe enough for you to win disability benefits, and because of this you may find you are faced with the decision of whether you should quit your job because you don’t feel you can do a good job at work anymore. Added to your stress is that sometimes employers are also pressuring to you to quit your job because you are missing too many days for doctor’s appointments, may need surgery, or you simply cannot get out of bed. Because of such pressures, it is not uncommon for a disability claimant to make poor decisions and/or listen to advice from people who simply do not know the best approach in your situation (i.e. some Human Resources person at their job, their friends, family, the neighbor, etc).

If you are employed and you have Short Term and/or Long Term Disability coverage through your employer, whether you are employed through a private company or employment through a local or State of Arizona employer (ASRS), DO NOT quit or resign. Even if your employer recommends or asks you.  If you are given such advice by your employer/boss/supervisor or anyone else, instead contact a Long Term Disability attorney immediately, because if you voluntarily quit or resign your position, you will likely sever any vested ERISA or Arizona State (ASRS) rights you have with your employer, which includes rights to Short and Long Term Disability benefits, benefits that are supposed to be there to pay you thousands of dollars over many years when you are no longer able to work.

So before you make any decisions, call us. We offer a free initial consultation (in-office or by phone, if you can’t make it to the office due to illness) and in most cases you will not pay anything until and if we win. Call the Law Office of Paul J. Dombeck in Phoenix, Arizona at 602-648-2035. You will be talking directly to an attorney who will advise you on the best approach for your particular case.
